Hamberger accused of taking firearm from evidence room

Scott Alan Hamberger, a former deputy with the Sheriff's office, has been indicted on one count of theft of a firearm.

It was one of six indictments handed down by a Clay County grand jury June 21. The indictment was sealed until he could be brought into custody. Hamberger turned himself at the Archer County Sheriff's Office last Wednesday, June 30, where a Texas Ranger was awaiting his arrival.

Hamberger is accused of stealing a firearm from the evidence room of at the CCSO.

District Attorney Jack McGaughey said it is believed that Hamberger took the gun sometime before January 2009, when Sheriff Kenny Lemons took office. It was discovered missing when Lemons ordered an inventory of the evidence room shortly after settling in.

Another man, Todd Luan, has also been indicted in the case, by an Archer County grand jury. He is charged with tampering with evidence.

Appeantly, said McGaughey, Hamberger gave the gun to Luan to dispose of. Luan did so by throwing the firearm into a stock tank, but the gun was recovered.

Hamberger joined the CCSO Nov. 30, 2000 and resigned Feb. 27, 2009. He spent 10 months with the Holliday Police Department before resigning in March due to the criminal charges.
